One day following the U.S. Supreme Court's decision against Texas in its legal dispute with the federal government over wire barriers at the border, Montgomery County officials unanimously passed a resolution denoting an invasion and expressing their support for Governor Greg Abbott's border security mission, Operation Lone Star. After the vote on Tuesday, Montgomery County Judge Mark Keough expressed his thoughts on the Supreme Court ruling, stating, "I believe it is time for Texas to exhibit some civil disobedience." Under Operation Lone Star, Texas had erected concertina wire barriers to deter illegal entry between ports of entry on its territory. However, when Border Patrol agents began dismantling these barriers, Texas filed a lawsuit. The Supreme Court overturned a ruling by the Fifth Circuit Court, granting Border Patrol agents the authority to remove Texas' concertina wire barriers in Eagle Pass, Texas, as the case progresses. Following the ruling, Governor Abbott affirmed his commitment to defending Texas' constitutional authority to secure the border and prevent the Biden administration from causing damage to their property. For over a year and a half, some residents of Montgomery County have urged county officials to declare an invasion. One of these residents is Jonathan Hullihan, a Montgomery County resident and General Counsel for Citizens Defending Freedom. Hullihan, who possesses expertise in international law and national security law, serves in the Navy Judge Advocate General's Corps reserves and has been deployed to Iraq and Afghanistan. Hullihan argues that Texas holds the constitutional power to declare an invasion at its border with Mexico and take measures to repel it. He cites the "Guarantee Clause" of the U.S. Constitution (Article IV, Section 4) and other historical precedents, including a legal opinion authored by former Republican Arizona Attorney General Mark Brnovich.
